They're not appealing to me.
The CPS would have dropped a case like this and run a mile! If NE go anywhere near the High Court on this many farmers will be there with you and the press in support i am sure... enough is enough. When will NE learn that their place in society is to advise... that is all...Permission to appeal was granted. Still all ongoing.
NE knows best??
Mixed hazardous waste. What was being dumped there?
Thats a significant question, its a 'illegal' flytipping site of approx 4 hectares within a woodland setting. Trees were allegedly felled unlawfully and then buried. What was being dumped there?

Because it is unlicenced, no records of contents of spoil, which is said to be 3-4 metres deep. Allegedly owned by Ashford borough council, who allegedly
a)have not consented
b)have not stopped it, despite reports back to 2004
c)have not responded to residents reports
d)deny liability under the Wildlife &Countryside act through exemption.
There is much information online, being campaigned by Kent Wildlife trust who 'manage' ground in the vicinity. They do not seem to volunteer to repair the damage !
Apologies, was 2020. Mis-keyed in editing date. And this was allowed to happen for 20 years?!

If it is an NE controlled site then they should clean it up as they designated it and the owner has no control anymore... they could do it with the money they save by not pursuing AJCC in the High Court if they are that wealthy...Jebus, that will be difficult and costly to clear up. What a mess.
Just D5 dozer it back into the highway.. after all the councils cause the fly tipping problem and own the roads... do it at night... and dont get caught.. just like them..Indeed, but it may have saved 1000 farmers' gateways ?
Not only have they lost their case, they now seem hell bent on throwing good money after bad.NE knows best.
NE appear to have either sacked their legal representatives or been deserted by same (having paid them somewhat over half a million of taxpayer monies too date in EIA 1348 case ) and are now going to proceed under their own legal dept. steam. . . . . Doubtless still funded by an unsuspecting public purse!
NEmesis.
I'm sure it could garner a lot more support and put a bit of pressure on those autocratic barstewards at N E.
