BPS reference data transfers

Does anyone know whether there is a limit to how much de-linked BPS reference data a business can acquire? I'm getting conflicting messages from different land agent sources. One says that any given business is limited to a reference data total of the amount they claimed (in nominal ££, before reductions) in BPS in 2023. The other says you can have more than that. Does any one know what the truth actually is, or point me in the direction of some guidance?

What's it any good for anyhow??

If you've made changes to your business (such as selling or giving up land, splitting a business, a death or inheritance) in the years 2020 to 2023 then you may have reference data for de-linked payments that you cannot claim on. And other people may be eligible for de-linked payments but have no reference data. Thus there is a need to be able to transfer reference amount between businesses.

Apologies that this isn't relevant to the thread but the posters on it will know the answer....

Our landlord is no longer actively farming. I kept telling him this time last year that he had to get his BPS claimed or he would lose it for the rest of its days. He never did and is now bemoaning lack of cash. Is there any point at all in him contacting RPA, maybe spin them a line that his land agent messed up or something ? Or pointless exercise ?

Does he have de linked payment. If so he can transfer it to a 'tame' eligible BPS claimant who claimed in 2023 and then the 'tame' person might settle with the landlord.

No de-linked payment. He didn't claim in 2023 or 2022 which is why I told him he had to get a claim in last year or he would lose any future payments, there was a cut off date around this time last year but he did nothing. Seems to have been a breakdown in communication between him and his then land agent, hence wondering if he could use this as a 'defence' with RPA ?

You are not clear Delilah. Any SBI that claimed in any of or all years 20, 21, 22 will have a delinked amount. Irrespective of claiming in 23. Your post implies he did claim before 22 and 23.

My understanding is that he received his BPS payment up to 2021. If I can find out from him what element of that 2021 payment was delinked you think he would be able to, via a third party claimant, still claim that money for 2022 onwards ?

If he received a BPS payment in 20 and or 21 he should have received a delinked statement. That would give the amount eligible. And he can transfer that amount. Sounds as though first thing to do is call the RPA with the fellow to check if he has a delinked payment and to ask if a replacement statement can be sent if he has lost it. Then speak with an agent. Townsends Exeter specialise in these matters and have some useful guidance documents documents on their website.

Thank you. This time last year he said he can't log in to RPA as 'agent always did this stuff', I had given up on trying to assist but he is now in a right pickle. Will ask for any paperwork he has and then phone RPA with him in search of a delinked payment trail.

Probably find he has never logged into RPA account. Agent always done this. I have come across a few old boys like this. Patience required. Call RPA with him with the SBI number and explain if he has no memorable dates etc set up. Its really irritating if cannot get through to RPA unless live next door and can try again tomorrow. I did one of these couple weeks ago. Was lucky got through to helpline after 15 minutes and a really brilliant operator with patience of Jobe helped set up two old boys whose brother died a year ago but had never registered the two 'lads'

I finally got a response from the RPA:

So it seems anyone with an SBI who already qualifies for delinked payments can import up to £30k worth of reference data (and thus boost their delinked payments) without any restrictions.
